DWAI Law Up Close

In New York, DWI/DUI law comes with a variety of consequences based on the number of previous offenses and the intoxication of the driver. They break down as follows:

  • Driving while ability impaired by alcohol (DWAI):
    • First offense: Fines between $300 and $500, a maximum of 15 days in jail and a license suspension of 90 days
    • Second offense: Fines between $500 and $750, 30 days in prison and a license revocation of at least six months
    • Third offense and beyond: $750 to $1,500 in fines, a maximum of 180 days in prison and a six-month license revocation
  • Driving while ability impaired by a combination of alcohol and drugs (DWAI/Drug):
    • First offense: Fines between $500 and $1,000, a maximum of one year in jail and a license revocation of six months, minimum
    • Second offense: Fines between $1,000 and $5,000, a maximum of four years in prison and a license revocation of at least one year
    • Third offense and beyond: $2,000 to $10,000 in fines, a maximum of seven years in prison and another one year of a license revocation

However, these fines are aggravated by the level of a person’s impairment. If a person has a blood alcohol content (BAC) of more than .18, then they will see higher fines and longer license revocations.
