Failure to signal leads to drunk driving charges in New York

On Behalf of | Apr 24, 2017 | DWI |

Countless individuals have been arrested following accusations of driving under the influence of alcohol. Determining intoxication can be a delicate process, especially with numerous issues, such as medical conditions, often exhibiting similar signs. Unfortunately, drunk driving is often the initial assumption of arresting officers. A man has recently been arrested following allegations of driving under the influence in New York.

Police say they initiated a traffic stop on a recent Thursday when the driver failed to use a signal. The man was subsequently taken to the police barracks, where he allegedly provided a breath sample that was over the legal limit. There was no indication of what may have led authorities to assume the man was intoxicated at the time of the traffic stop.

Individuals who operate a vehicle while intoxicated are often incapable of keeping a vehicle between the lines. They have also been the cause of countless collisions over the years. However, in this situation the only behavior listed was failure to signal, which could be considered a common occurrence among a myriad of drivers every day.

When a person is facing charges for drunk driving, there must be sufficient evidence to prove he or she was intoxicated at the time of the incident before a conviction can be obtained. This can still be a stressful and trying process, prompting many accused individuals to seek guidance and advise from a defense attorney. An attorney in New York may be able to question the validity of the tests used during the arrest procedure and advise a client on the best way to challenge pending charges during subsequent proceedings.
